Subject to the limitations set forth
below, CMS warrants that its products will be free from defects
in materials and workmanship, under normal use and service, for
the following periods of time from the date of purchase from
CMS or it’s authorized reseller:

- Velocity2 2-Drive & 5-Drive Redundant Backup Solutions - 1 year
- BounceBack Server 2-Drive Redundant Backup Solutions - 3 years
- ABS-Server Backup Systems - 1 year
Terms & Conditions of Warranty
If a product does not operate as warranted
during the applicable warranty period, CMS shall, at its option
and expense, (1) repair the defective product or part, or (2)
deliver to Customer an equivalent product or part to replace
the defective item. All products that are replaced will become
the property of CMS. Replacement products may be new or reconditioned.
Any replaced or repaired product or part has a ninety (90) day
warranty or the remainder of the initial warranty period, whichever
is longer.
Warranty does not apply to equipment
that has been damaged or rendered defective (a) as a result of
accident, misuse or abuse; (b) by the use of parts not manufactured
or sold by CMS; (c) by modification without prior written consent
from CMS; (d) damage resulting from transit, neglect, power surge
or failure, or operating environment; or (e) any event due to
normal wear and tear. Hermetically sealed storage products must
not be opened, or warranty will be void. CMS shall not be responsible
for any software, firmware, information or memory data of Customer
contained in, stored on, or integrated with any products returned
to CMS pursuant to any warranty, nor for any consequential damages
resulting from the failure of any CMS product or the loss of
information resulting from the use of CMS products.
Warranty service may be obtained by contacting
CMS within the applicable warranty period for a Return Material
Authorization (RMA) number. Once an RMA number is issued, the
defective product must be shipped back to CMS prepaid, insured
and wrapped in the original or similar shipping package to ensure
that it will not be damaged during shipment. When returning defective
product to CMS for service, the RMA number must be marked on
the outside of the shipping package. Any product received at
CMS not packaged properly may be rejected as out of warranty,
if appropriate. Physically damaged products will not be processed
for warranty.
Any product returned without an RMA number
shall be rejected and sent back to the Customer, and CMS disclaims
any obligation to pay for the shipping of any such returned product,
it being understood that the Customer shall bear the cost of
returning such products.
CMS warranty periods are subject
to change without prior notice. Warranty coverage may be obtained
